Lawsuit -- Dr. Phil Trapped Me, Touched My Breast

Dr. Phil is being sued by a woman who claims the TV shrink held her captive inside his production offices, forced her to stare at a naked man -- and then grabbed her left breast.

According to the suit, filed today in L.A. County Superior Court, a woman named Shirley Dieu claims she went to Phil to seek therapy in 2007 -- but instead she claims the doc tried to "brainwash" her and force her to endure all sorts of physical and emotional abuse.

In the docs, Shirley claims Phil forced her to "be in the same room with a completely naked live man while he exposed his entire naked body, genitals and all."

Shirley alleges she tried to escape the building, but "was blocked by the staff to prevent her from leaving."

In the docs, Shirley also claims Phil "touched her left breast during her therapy session."

Shirley also claims Phil lied to her about being a "real" doctor -- alleging that the TV shrink "is not licensed to practice in the state of California."

Shirley doesn't specify how much money she wants from Phil -- but we're assuming it's an insane figure.

The last lawsuit that Dr.Phil was slapped with was just weeks earlier -- five "Dr. Phil" fans sued the very show they once loved -- after a road trip to catch a taping of the program allegedly turned into the worst experience of their lives.

According to the lawsuit, filed last month in L.A. County Superior Court, the brakes on the bus "failed and lost power, making the bus unable to stop" ... causing it to collide with "another vehicle, two concrete curbs, an iron fence and two trees."

This TV personality, who is not even currently licensed as a psychiatrist is once again in hot water. This is not the first time that "Dr. Phil" has been accused of sexual misconduct or abuse. Although he is practicing "medicine" in California without a license, it seems Phillip McGraw is certainly doing his best to be "one of the boys", and showing the world how much of a psychiatrist he truly is. 10% of psychs admit to sexually abusing their patients. Dr. Phil is currently denying these claims, (as he's denied others) putting him in the category of the other 90%. More information to come.

The information presented was obtained from official reports and other now-public documents. Regrettably, as of the APA Convention in August, none of the organization's positions as described in this video has changed.

A brilliant and shocking overview of the direct involvement of the APA in the torture of cpatured prisoners. Are these the monsters who should be voting on what is or is not a "mental illness"?

Psychologist accused of war crimes opposes torture investigations

As a conflict has arisen as to whether the nation should seek accountability for torture and other human rights abuses during the so-called “War on Terror,” the public and media have largely ignored the spectacle of those, like Richard Cheney and John Yoo, who are likely targets of human rights abuse investigations. Potential investigations are denounced as political attacks that will gravely damage the country’s security. The media have largely ignored the self-serving nature of these denunciations.

The latest human rights abuse target to join the anti-accountability chorus is former Guantanamo intelligence psychologist Col. Larry James (retired), about whom questions have been raised regarding unethical or even illegal participation in war crimes. In a press release from Wright State University, where he is now Dean of the School of Professional Psychology, James –– has come out against Attorney General Holder’s limited criminal investigation of CIA torture :

“To reopen cases that were adjudicated as legal may be harmful to the mission and morale of the intelligence community,” said Col. (Ret.) Larry James, now the Dean of the School of Professional Psychology at Wright State University. “That said, I agree with President Obama’s statement several months ago to ‘turn the page’ and move on with regard to the interrogation of detainees of the Global War on Terrorism.”

James said the outcome of appointing the special prosecutor could have negative repercussions on the intelligence-gathering function.

“Being an interrogator is a stressful, challenging and dangerous job,” he said. “If there is new evidence that suggests crimes have been committed, then it would make sense to move forward with an investigation. However, since at the time of the interrogations they were deemed legal and acceptable by that sitting administration, I do not believe the investigation is warranted or necessary. I advise the president to be supportive of our current mission and be very careful as he moves forward in this sensitive area.”

James has previously made clear his belief that intelligence professionals should close their eyes to possible abuses outside of their immediate sphere of action. Thus, when asked by an Associated Press reporter to comment on reports of a secret Camp 7 at Guantanamo, James replied:

“I learned a long, long time ago, if I’m going to be successful in the intel community, I’m meticulously _ in a very, very dedicated way _ going to stay in my lane…. So if I don’t have a specific need to know about something, I don’t want to know about it. I don’t ask about it.”

Like so many others arguing against torture investigations, James may have reason to desire a shut down of torture inquiries. Last month, the Canadian Centre for International Justice and the Center for Constitutional Rights appealed to the Canadian government for a criminal investigation of James for potential involvement in war crimes:

“Allegations of abuse during Dr. James’ January to May 2003 deployment include beatings, religious and sexual humiliation, rape threats and painful body positions. Canadian citizen Omar Khadr is one of the prisoners who has alleged brutal treatment in the spring of 2003 when he was only 16 years old.

“Based on this information, the CCIJ and CCR called on the Canadian government to investigate whether action should be taken against Dr. James or other attendees of the APA Convention who may have been involved in abuse of detainees.”

The two human rights organizations outlined the evidence justifying a criminal investigation in a background document they presented to the Canadian government. At that time, James was in Toronto for the annual meeting of the American Psychological Association [APA], where he became President of the APA Division of Military Psychology Among the serious concerns regarding James’s behavior warranting investigation are that he consulted to interrogators at Guantanamo while isolation was part of the standard operating procedure to make new detainees dependent on their interrogators.

James, however, has repeatedly claimed credit for ending all abuses at Guantanamo, and later, at Abu Ghraib. Thus, his sanitized memoir detailing these claims is entitled Fixing Hell. Similarly, James told a task force convened by the American Psychological Association in 2005 that he and other psychologists ended abuses at detention facilities:

“I am very proud of the fact, it was psychologists who fixed the problems and not caused it. This is a factual statement! the fact of the matter is that since Jan 2003, where ever we have had psychologists no abuses have been reported.” [Emphasis in original.]

James has an idiosyncratic definition of “abuse.” He claims at times never to have witnessed abuses at Guantanamo, where he was deployed as a member of the Chief Psychologist of the Joint Intelligence Group and BSCT #1 [Behavioral Science Consultation Team] in 2003 and 2007:

“When I walk through the camps, I can’t tell you that I have stumbled across a lot of things that are wrong. During my time here, I am proud to say that I have not seen a guard or interrogator abuse anyone in any shape or form,” said James. “These young men and women go out of their way well beyond the call of duty to make sure that detainees are treated safely and humanely at all times.”

James’s account, of course, differs from that of every independent source that has examined Guantanamo and found persistent abuses continuing up to the present. [Even in his own account of his deployment at Guantanamo in his self-justifying "memoir," James reports witnessing several instances of abuse - abuses which, however, he apparently failed to report to his commanders.]

In his memoir James claims to have had special responsibility for juveniles detained at Guantanamo. Yet, during his deployment there, young Mohammed Jawad [evidently between 12 and 16 when incarcerated there] was subjected to the mandatory four weeks isolation upon his arrival in February 2003. Later that year Jawad was subjected to further isolation and other abuse on the recommendation of a BSCT psychologist; James declined to condemn this abuse to a Newsweek reporter, implying that there were extenuating circumstances. Later, in May 2004, Jawad was also subjected to extended sleep deprivation in the so-called “frequent flyer program” in which, in the words of his military JAG attorney:

“Mohammad Jawad’s arms and legs were … shackled in preparation for the first of 112 moves up and down the hall of L Block, every 3 hours for the next 14 days.”

Also while James was deployed at Guantanamo, adolescent Omar Khadr reported being used as a human mop “because he had urinated on himself during a bout of shackled isolation.” The claim was investigated by the military, which has refused to release any information regarding the investigation. Records released by the Canadian government show that Khadr, like Jawad, was subjected to the “frequent flyer” sleep deprivation program in 2004. Despite his professed concern for the decent treatment of juvenile detainees, other than his Newsweek comment, James nowhere describes his relationship to the Jawad or Khadr cases or comments on the documented abuse these young boys suffered at Guantanamo during and after his deployment.

Does James believe that no investigation of his actions at Guantanamo is warranted as his actions there “were deemed legal and acceptable by that sitting administration”? In other words, was he just following orders?

Due to the secrecy surrounding Guantanamo, we do not know James’s actual conduct at Guantanamo. With his call to stop investigations of detainee abuses, James seems to desire that we never know. If he is innocent of participation in abuses, only an investigation will clear his name. If, however, he did participate in abuses, no defense that “at the time of the interrogations they were deemed legal and acceptable by that sitting administration” should be allowed to obscure the truth, and no claims of damage to the morale of the intelligence community should be allowed to impede an investigation and appropriate criminal and/or professional penalties.

Only the full truth can allow the abused detainees, the nation, and the profession of psychology, to “turn the page and move on.” In the absence of the truth we will be forever looking over our shoulders, wondering just who did what and what did happen during this sorry chapter in our nation’s recent history.

The horror show of psychological warfare and interrogation torture continues on. This is an exceptionally well-researched article by Stephen Soldz, who is a psychologist, himself. The few brave individuals in the industry, who are willing to come forward and speak out against such brutal, inhuman practices should be commended for doing so.

James appears to be completely out-of-touch with reality, and suffering from quite a bit of "cognitive dissonance", given his statements on the nature of abuse, and just what his purpose was when he was overseeing the treatment of prisoners at Guantanamo. Should we expect to hear from more of those victims, or will they be quietly "taken care of", before they get the chance to tell us what really happened? It wouldn't be the first time detainees were murdered by their captors.

The fearlessly independent Physicians for Human Rights — founded in 1986 and sharer of the Nobel Peace Prize in 1997 — has once again exposed the shameful role of doctors and psychologists throughout the CIA’s torture interrogations, banned by the international Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, as well as in the Geneva Conventions and our own statues.

Despite all the attention and furor when the former CIA Inspector General’s 2004 report was finally released through an ACLU lawsuit — to the rage of objectors Dick Cheney and CIA Director Leon Panetta — the continuing debate has yet to focus on, and deal with, the Physicians for Human Rights Aug. 31 report:

“Aiding Torture: Health Professionals’ Ethics and Human Rights Violations Demonstrated in the May 2004 Inspector General’s Report” — with additional incriminating details that “CIA Health Professionals’ Role in Torture Worse Than Previously Known.”

The startling indictment is that “health professionals were involved at every stage in the development, implementation and legitimization of this torture program.” They were as disgracefully complicit as John Yoo and the other Justice Department lawyers who provided torturously manipulated “legal” cover to the CIA and its bosses in the Defense department and the Oval Office.

Preceding the waterboarding, the confinement of battered, shackled terrorism suspects in boxes so small they could only crouch, very prolonged sleep deprivation, et al, there was the “intake process closely linked to the process of interrogation.”

As Dr. Steven H. Miles painstakingly described in his path-breaking accounts of the self-degradation of these health professions — “Oath Betrayed: America’s Torture Doctors” (paperback, University of California Press, 2009) — the psychologists had information about the prisoners to indicate their possible phobias and other vulnerabilities. They informed the interrogators using “enhanced” techniques on how best to “crack” these suspects.

Furthermore, “by requirement,” Physicians for Human Rights reports, “all interrogations were monitored in real-time by health professionals.” They not only saw it all as it happened but were committed to making the torture as effective as possible.

For instance, “a medical device called a pulse oximeter (a device to measure oxygen saturation in a subject’s blood) was placed on the finger of a detainee to monitor the effectiveness of his respiration during waterboarding ... to calibrate physical and mental pain and suffering.” Don’t let up now!

Since there is clear evidence of deaths during interrogations — from Defense Department autopsy reports obtained by the ACLU and the scrupulous reporting of the New Yorker’s Jane Mayer — did any of these on-the-spot doctors and psychologists intervene before it was too late?

What makes this Physicians for Human Rights documentation so nightmarish are the details. For example, we’ve heard of suspects often being hooded. What’s so terrible about that? But what was hooding actually like? Will we ever know?

This PHR report quotes from a February 2004 report by the International Committee of the Red Cross (ICRC) on interrogations in Iraq, but as PHR has previously noted, “hooding was used both during transportation and during interrogation,” not only in Iraq. And we can only guess what special forms of hooding were invented in the CIA’s secret prisons.

This is what the ICRC found: “Hooding (was) used to prevent people from seeing and to disorient them, and also to prevent them from breathing freely. One, or sometimes two bags, sometimes with an elastic blindfold over the eyes which, when slipped down, further impeded proper breathing.” And during beatings, the hooded prisoner was all the more anxious and apprehensive as to when the blows would come and where.

Also, “Hooding could last for periods from a few hours to up to 2 to 4 consecutive days, during which hoods were lifted only for drinking, eating or going to the toilets.”

And where were the doctors and psychologists?

One detainee cited in the ICRC report, Mr. Bin Attash, claimed he was forced to wear a diaper for a long time. He told the International Red Cross “on several occasions the diaper was not replaced so he had to urinate and defecate on himself while shackled in the prolonged stress standing position.”

And “three other detainees specified that they had to defecate and urinate on themselves and remain standing in their own body fluids.” Physicians for Human Rights adds: “The placement of a normally continent adult in a diaper will likely lead to efforts by the adult to resist urination or defecation, which in turn will likely result in bowel cramping and bladder spasm.”

Calling this, and so much more, “an unconscionable affront to the practice of medicine” (and psychology), Physicians for Human Rights, as I’ll report next week, has urgent recommendations on the accountability of health professionals for these affronts — committed in plain view of professional “caregivers” — in the name of all us Americans.

Psychs are continuing to do what they do best, in their depraved crusade to"socialize" man with dehumanization and abuse. Perhaps it's "projection" on their part that they view man as simply an animal to be broken. When we get reports like this one, it's difficult to disagree with their assessment, so far as it is a reflection on their own soulless state of being. Should we really believe that these same sadists have the best interest of their patients at heart, once they leave the CIA secret prisons, and go back into their hospitals and offices? Are these the "authorities on the mind" that you look to for guidance?

Anna Nicole Smith and her psychiatrist were captured on film in various contorted sexual positions, according to new legal docs.

We reported this morning that the legal docs describe Anna Nicole and Dr. Khristine Eroshevich naked in a bathtub together. Authorities claim the two women had a personal relationship "that crossed the boundaries of professionalism."

The documents are very specific: "One photo showed both naked women embracing while looking at the camera. In another photo, Dr. Eroshevich is sitting between Anna Nicole Smith's legs while Anna...was in a more reclined position.

In the third photo, Anna Nicole Smith has her ankles on each of Dr. Eroshevich's shoulders while they are holding hands and their clasped hands are resting in the area of Anna Nicole Smith's vagina posing for the camera."

More than a year ago we saw a photo of Anna Nicole and Dr. Eroshevich, naked in a bathtub with a sex toy nearby. We did not publish the photo.

It seems not only was Psychiatrist Khristine Eroshevich conspiring to get patients high-as-a-kite with fatal results, she also exploited her position as a trusted professional for her own sexual gratification. This story becomes more and more disgusting by the day. It's also worth noting that TMZ apparently does have some "scruples" afterall, when it comes to drug-pushing psychs who sexually exploit and kill their patients, anyway. Nice work, TMZ. How many more victims of this psych could have been warned had the media done their job? It seems ratings and profits aren't the only thing motivating these merchants of chaos, afterall.

Details are emerging that the psych in question was "openly gay", and that her and ANS were seen marching together in a gay pride parade. The lawyer representing the psych concedes that she is indeed a lesbian, but contends that she has not had sex with any woman whatsoever, including her patients. This seems a somewhat dubious claim given descriptions of the photographs and their using a dildo as a prop while naked in a bathtub together.

Should the late Anna Nicole Smith bear some responsibility for this unhealthy relationship built upon promiscuity and drugs, or is the psych whom she entrusted fully to blame for her tragic ending, and the shameful details that came before?

Khristine Eroshevich prescribed 'pharmaceutical suicide' to Anna Nicole Smith

Anna Nicole Smith's psychiatrist Khristine Eroshevich prescribed the equivalent of "pharmaceutical suicide" in the days after the death of her son, according to court records obtained by the Los Angeles Times.

On at least three occasions, pharmacists refused to fill drug orders prescribed by Eroshevich and Smith's internist Sandeep Kapoor, who are each facing several counts of illegally prescribing controlled substances to the late model and obtaining opiate prescriptions by fraud.

Five days after the death of Smith's son, Daniel, (and eight days after Smith gave birth to her daughter Dannielynn), Eroshevich tried to prescribe two sedatives, 300 tablets of methadone, a muscle relaxer, an anti-inflammatory drug and 4 bottles of a painkiller called "hospital heroin."

"They are going to kill her with this," one of the pharmacists told himself at the time.

He then called the Kapoor and told him the drugs amounted to "pharmaceutical suicide." Smith died of a prescription drug overdose five months later.

The day after Daniel's death, Eroshevich also allegedly asked a pharmacist for chloral hydrate to help Smith sleep, according to the documents. "I wouldn't give her chloral hydrate unless you want your picture on the front page of the National Enquirer," the pharmacist reportedly told her, but did fill the prescription for what is considered an out-of-date treatment for insomnia, according to the Times.

The documents also revealed what the Times politely calls "lack of professionalism" by the two doctors. To whit: Photos of Smith and Eroshevich naked and embracing in a hot tub in the two months before Smith's death, and a video showing Smith "kissing and nuzzling" a shirtless Kapoor.

Kapoor's lawyer calls the documents "a misreading of the medical records," while Eroshevich's lawyer says the psychiatrist "was in a position of either doing nothing and leaving a psychologically unstable person to fend for herself or attempt to help Anna even if the circumstances surrounding the treatment were less than ideal."

Instances of psychiatric abuse, and fraud are common, but it is not everyday that celebrity deaths are linked to these cocktails of chaos. With new details unfolding on the twisted relationship that Anna Nicole Smith had with Eroshevich, it is seeming more likely her psychiatric "treatment" led directly to her death.

Few yardsticks in life are better than the headline test. Try it on this one: "Sex offender keeps license
to practice psychiatry."
It gets worse, as in: "Doctor's offense involved a 10-year-old neighbor."
To say that something is out of whack in state law is an understatement. The case involves Dr.
William Olmsted, a child psychiatrist who pleaded no contest to a molestation charge in Dallas
County but was able to skate past the State Medical Board with his license intact, albeit with
restrictions.

Sen. John Carona, R-Dallas, has vowed to look into the matter, and we're encouraged that he will.
Those who have a state license to treat people at their most vulnerable must be beyond reproach.
Those listed on the state's sex-offender registry could not ﬁt into that category.
State law should be tightened up so future Olmsted-like cases don't fall between the cracks of separate
state codes governing criminal, licensing and administrative law. By the time the State Medical Board
got the Olmsted matter, it was six years old and involved a sentence of deferred adjudication –
probation, essentially.
The age of the case and absence of a guilty verdict did not permit the board to immediately suspend
Olmsted's license. Pursuing revocation could have involved proceedings lasting as long as two years
before a separate state hearing agency, and all the while the doctor could have continued to practice as
a child psychiatrist.
The deal cut with Olmsted involves treatment and a ﬁne, but it let him keep his medical license with
the restriction that he treats only adult males in group or institutional settings. The fact that he has any
kind of professional license at all leaves us aghast, but not nearly to the level as the psychiatrist's
victim and her family.
Changes in state law might seek to insert deferred adjudication as a license-suspension trigger, or
cases involving sex offenses may need to be expedited through the hearing process. We'll watch
Carona's conclusions with interest as he looks for ways to bring sense to the licensing process.
The spirit of his inquiry ought to be driven by the determination to hold state-licensed physicians to
the highest standard in Texas.

It is estimated that at least 10% of psychiatrists sexually abuse their patients. This is certainly not an isolated incident. Like with most cases where psychs come under fire for their sexual deviancy and abuse of power, there was a virtual media blackout. Phillip Garrido, who is still making headline news over the alleged kidnapping and rape of an 11 year old girl who remained confined in his backyard for 18 years, may have been on prescription medications and under the care of a psychiatrist the entire time.

Mainstream media has bent over backwards to ignore this stunning revelation that appears in documents released by the FBI. The documents are a part of what the media is referring to as the “manifesto“, and is titled “Origin of Schizophrenia Revealed”.

In what Garrido has called his “book”, he reveals his ability to explain and reproduce sounds telepathically, gives an overview of his Christian beliefs, and claims his kidnapping and sexual abuse of a child eventually led him to heightened spirituality and a more intimate relationship with his wife, upon repenting of his sins. Mainstream media quickly milked the documents for all they were worth, with a single exception.

Aside from a brief, incomplete and rather spun mention by CBS, no news organization has revealed what is perhaps one of the strangest elements of the case. Phillip Garrido appears to have been under psychiatric care during the entire 18 years of Jaycee Dugard’s horrific ordeal. The document released to media upon request by the FBI, states “Concerning Phillip Garrido’s state of mind: Mr. Garrido has been under the care of a psychiatrist for the past 18 years for Attention Deficit Disorder (ADD). If a reference is needed I will supply a release form upon request and you may contact him yourself.” The name of the psychiatrist has either been redacted by the FBI or was not in the document to begin with, though credentials are listed therein.

While many bloggers and journalists are hung up on the apparent religious angle of the story, speaking of Garrido’s founding of “God’s Desire Church”, the unsettling possibility that Garrido is the latest Frankenstein to come from a psychiatrist’s “treatment” of “mental illness”, is being ignored or downplayed. It will be interesting to see what else we learn, since it appears that Garrido is more than eager to share his thoughts, and his history. As you can see from the above video, Garrido is certainly no stranger to psychiatry, or drug use, and it leaves one speculating on just what role those may have played in his actions, if any.

If nothing else, it certainly does give one pause to find out that Garrido’s kidnapping of young Jaycee may have coincided with a prescription for stimulants.

It is interesting that the media has largely ignored this disturbing fact. Let's hope we eventually learn the identity of this psychiatrist, should Garrido have been in treatment as claimed. Is this yet another example of psychiatry failing those who relied on the supposed "experts" on mental health?
